RENTAL AGREEMENT

This rental agreement is valid for all rentals in the Ocean Oaks, Villas By the Sea, The Moorings at Jekyll Harbor, and our Homes on Jekyll Island.  This contract constitutes an agreement between the Renter and Parker-Kaufman Realtors, as Agent, to rent the premises you have reserved. RENTER MUST BE 25 in order to reserve and check-in. RENTAL RATES, FURNISHINGS, AMENITIES, AND EQUIPMENT ARE SUBJECT TO CHANGE WITHOUT NOTICE.

On or after July 1, 2021, each innkeeper in the State of Georgia is required to charge a $5.00 per night fee to the customer, unless it is an extended stay rental, for each calendar day for any room, lodging, or accommodation that provides physical shelter. The innkeeper shall collect the fee at the time the customer pays for the rental or lease of such lodging. Stays more than 30 days are only charged the fee for the first 30 days. There is no fee charged after day 30. If reservation was made before July 1, 2021, you are not required to pay the fee. If made on or after July1, 2021, the fee must be added to your reservation.

On or after January 1, 2022, Villas By The Sea Management Group is requiring realtors who manage units at VBTS to charge each guest a 5% resort fee. This fee will be added to EVERY reservation starting January 1, 2022.

Renter Understands and Agrees to the Following:

THE ACCOMMODATION:

The accommodation is a privately owned dwelling with the owner’s furnishings, and neither the Agent nor the Owner shall be obliged to provide furnishings or equipment not presently available in the unit. Renter agrees not to move furnishings from room to room, nor to remove any furnishings, kitchen equipment or utensils from the cottage. Renter agrees to pay a service charge up to $50.00 to have furnishings returned to their original rooms after Renter vacates.

RENTAL RATES:

Rental rates are based upon a 7-day minimum stay. Our rental week runs from Saturday to Saturday during peak seasons. During the off-season, other beginning and ending days may be possible. Shorter stays may be available and can be reserved within 10 days of your planned arrival date. Please contact us for details. RENTAL RATES ARE SUBJECT TO CHANGE WITHOUT NOTICE.

DEPOSITS:

A deposit in the amount of 50% of the base rental rate is due within 7 days of booking a reservation. The deposit will be applied to the total rent. The balance of the rent, taxes, reservation fee, cleaning fee or additional items you reserve is due 14 days prior to your arrival. Parker-Kaufman, Realtors, as Agent for the owner, may at its discretion place rental deposits in an interest-bearing account and is entitled to the interest earned on such deposits to cover administrative expenses.

CANCELLATION POLICY:

Effective January 18, 2024: ALL CANCELLATIONS MUST BE IN WRITING and can be sent via US mail or Email. It is the renter’s responsibility to check with our office to ensure we have received your notice to cancel a reservation. All cancellations entitled to a refund will be charged a $50 cancellation fee. Bookings cancelled 30 days before the start of the stay will receive a refund of the amount on deposit less the cancellation service fee. Bookings cancelled 29 – 0 days before the arrival date are not eligible for a refund. Refunds will be issued in the form of a check to the mailing address on the reservation. The $20 reservation processing fee is nonrefundable. Since all properties are individually owned, requesting a change from one cottage to another is considered the same as a cancellation.

CHECK-IN/CHECK-OUT:

Renter is expected to honor check-in time of 4:00 p.m. or after, and check-out time of 10:00 a.m. Renter may not enter unit until it has been checked and released by our inspector. Entering the unit prior to authorization will release Parker-Kaufman from any liability for cleanliness or damages. We CANNOT guarantee an early check-in, but we will do our best to have your unit ready as soon as possible. Any extension beyond departure date shall be on a daily basis only and only by written confirmation from Parker-Kaufman, Realtors.

FURNISHINGS:

All cottages are equipped with ranges, refrigerators, cookware, silverware, and dishes. Each is furnished, equipped and maintained according to the owner’s preference. No housekeeping is provided during your stay, so each unit is furnished with vacuum, broom and mop. Linens (sheets, towels, pillowcases, hand towels, washcloths and bath mats) are included with all Parker Kaufman rentals.

EQUIPMENT & APPLIANCES:

All of the rental cottages offer air-conditioning, heat, telephone, television, cable TV or Satellite service (some have upgraded digital cable service where noted). Parker-Kaufman cannot guarantee the operation of the air conditioning, or other appliances. However, we will do our very best to have any malfunction repaired as soon as possible. We cannot refund for TV, WIFI, air-conditioning or appliance malfunctions. IMPORTANT NOTE: Your refrigerator works best on the middle setting. If you have just arrived with room temperature groceries or hot items from your automobile, please allow at least 12 to 24 hours for the refrigerator to reach the proper setting.

We cannot guarantee that landlines at any rental property are in working order. In case of emergency, you should rely only on your cell phones for communication.  If this creates an issue for you, please contact us before you check in so that we can see what can be done to accommodate you in this regard.

NO PARTY HOUSES:

Renter must be at least 25 years of age and have no more in his party than the rental unit is advertised to accommodate. “House Parties” are prohibited and Renters will not create a disturbance nor a nuisance in the neighborhood.

MAXIMUM OCCUPANCY:

At no time will the specified maximum occupancy of any unit be exceeded. If the maximum occupancy is exceeded, the guest will be asked to leave the property immediately, and a fine in the amount of the rental deposit will be charged to the payment method on file.

REGARDING PET-FRIENDLY HOMES:

OUR PET-FRIENDLY HOMES ARE ENJOYED YEAR-ROUND BY PET LOVERS. OUR HOUSEKEEPERS DO AN AMAZING JOB AFTER EVERY DEPARTURE, BUT IT IS VIRTUALLY IMPOSSIBLE TO REMOVE ALL TRACES OF EVIDENCE OF THE HOUSE BEING PET-FRIENDLY.  IF YOU ARE NOT BRINGING A PET, YOU ARE CERTAINLY WELCOME TO RENT ANY HOME, BUT WE WILL NOT REFUND FOR DISSATISFACTION BECAUSE THE HOUSE IS PET-FRIENDLY.

PET POLICY:

NO PETS ARE PERMITTED in the accommodation without payment of a $150.00 NON-REFUNDABLE cleaning and extermination fee. NO PETS ARE PERMITTED where so indicated in the cottage description in the brochure or on the website. This rule will be strictly enforced and tenants in violation will be charged a $2500 cleaning fee and will be asked to vacate the premises with no refund.  Renters with pets agree to pick up the yard after their pets. Service Animals for the disabled are permitted without a deposit at any property, however renter will be liable for any damages caused by their Animal.

OWNER’S PERSONAL PROPERTY:

One or more locked closets in each unit are reserved for storage of the Owner’s property and are not included in this rental. Renter access is not permitted to these areas.

RENTER’S PERSONAL PROPERTY:

Rental agent will not be responsible for personal items the renter may leave in the rental unit. However, if the item is of importance, the renter agrees to pay the agent a $15.00 service charge in addition to the cost of packaging, and mailing the item.

LONG DISTANCE PHONE CALLS and PAY-PER-VIEW:

DO NOT CHARGE LONG-DISTANCE CALLS TO THE NUMBER OF THE RENTAL UNIT OR ORDER PAY-PER-VIEW OR ON-DEMAND PROGRAMMING. If such charges are made during the period of occupancy, the renter agrees to pay for all charges plus a $25.00 service charge.

DAMAGES:

Renter agrees to indemnify Owner for any damage to the rental unit grounds, furnishings, equipment, and household items therein, which occur during the renter’s period of occupancy, excluding normal wear and tear. Renter understands that any damages which are discovered to exist, or which occur during renter’s occupancy should be reported at the earliest possible time to the rental agent. The agent can not guarantee air conditioning, appliances nor electronic equipment.

DAMAGE WAIVER FEE

A Damage Waiver Fee is included in the total cost of all reservations. It protects you from incurring expenses related to accidental damage to your rental unit occurring during your stay PROVIDED DAMAGE IS DISCLOSED TO MANAGEMENT PRIOR TO CHECK-OUT. It is NOT an optional charge.

Why do we provide it?

Everyday life can be filled with stressful situations and when you go on vacation, you should be able to relax and enjoy your getaway. Our Damage Waiver Fee is designed to make your relaxation and comfort unspoiled. Instead of putting down a large up-front security deposit, this small fee offers protection for those little incidents. No more credit card holds or canceled check fees to worry about. No need to trouble over accidental damage in your unit. If something breaks, simply let us know immediately and your waiver will cover the cost to repair or replace the item. Most importantly, you are provided with the confidence to enjoy your vacation without worry.

What is included?

Minor, accidental damage to your unit and its contents during your stay such as: scratches on the doors, floors or walls, broken glassware, spills, stains, and broken furniture. Each registered guest is protected by this waiver and will not be obligated to pay for reported incidences of accidental damage to the unit and its contents up to $3,000 per stay.

What is not included?

Intentional or careless damage to your unit is not included. Your personal items are not covered. Damage discovered by management is not covered. All damage must be reported prior to checkout.

Coverage is not provided for:

  1. Damage related to an intentional act or gross negligence. These include but are not limited to: damage caused by a party, damage caused by smoking or pets and theft or removal of unit inventory.
  2. Damage related to violation of our rental policies.
  3. Damage to personal items.
  4. Damage caused by any person other than you or your traveling companions named on your reservation.
  5. Damage not reported immediately to management.
  6. Damages exceeding $3,000 in repair or replacement cost per stay.
  7. Loss or theft.
  8. If your rental is pet friendly, any damage caused by your pet ( service animals and emotional support animals included) is not covered by this Damage Waiver protection. This includes any additional cleaning needed due to the pet.

Your duties when damage happens:

  1. Take all reasonable, necessary steps to prevent further damage.
  2. Report damage in writing to management prior to check-out.
  3. Provide management with all related documentation such as a police report or repair estimate.

You are responsible for all damage to your rental unit and its contents occurring during your stay not covered by damage waiver fee. Your credit card will be charged for any damage not covered by damage waiver fee.

VIOLATIONS:

If Renter or any member of Renter’s party violates any of the conditions or agreements of this contract, this contract may be terminated by Agent.

ENTRY TO PREMISES:

The Agent or service personnel may enter premises for purposes of effecting necessary repairs, maintenance, and pest control.

AGENT FOR THE OWNER:

Parker-Kaufman Realtors acts as Agent for the Owner of the individual cottage and shall not be liable for damage or injury to renter or to any other person or to any property occurring on the premises or any part thereof, and renter agrees to hold Agent and Owner harmless from any claims of damage, no matter how caused. The agent will not be responsible for acts of theft or vandalism or other damage to renter’s personal property. PARKER-KAUFMAN, REALTORS, HAS ACTED AS AGENT FOR THE OWNER IN THIS TRANSACTION AND IS TO BE PAID A COMMISSION BY THE OWNER. PARKER-KAUFMAN HAS NOT ACTED AS AGENT FOR THE RENTER IN THIS TRANSACTION.

WHAT TO BRING:

These items are not provided by the owner or Parker-Kaufman.

  • PAPER PRODUCTS:
      Toilet tissue, paper towels, trash bags, coffee filters, etc.
  • CLEANING SUPPLIES:
      All-purpose cleaner, bathroom cleaner, glass cleaner, floor cleaner, etc.
  • PERSONAL ITEMS:
      Hand soap, shampoo, conditioner, lotion, etc.

NOTE:

A basic supply of linens, paper products, and toiletries are provided for those renting units at Villas By The Sea.

**A basic supply of linens (sheets, towels, pillowcases, hand towels, washcloths and bath mats) are provided for all rentals.**

Linens are not refreshed during your stay.

A starter set of paper products (a roll of kitchen towels and 2 rolls of toilet tissue) and a few cleaning supplies are included. THESE ITEMS WILL NOT BE REPLENISHED.

IMPORTANT:

Parker-Kaufman cannot guarantee that public beach crossovers are fully functional at any given time.  Due to the harsh environment in which these crossovers exist, they are always subject to the impact of the changing tides, weather, wind, etc. Please contact the Jekyll Island Authority at 912-635-2236 for up-to-date information on beach access closures.
